A patent violation that will cost Apple $ 502.8 million. The jury of the court of justice of Tyler (Texas) finally ordered the company of Cupertino to pay this sum to VirnetX. According to him, Apple does indeed use its network technologies for its VPN on demand functionality and for FaceTime.
“This case has been going on for over a decade, with patents that are unrelated to the basic operations of our products and that have been ruled invalid by the patent office. Cases like this only serve to stifle innovation and harm consumers ”Apple said after the verdict.
A long history between the two companies
This legal confrontation actually dates back ten years and has seen many back and forths. Already in 2018, the Texas federal court ordered Apple to pay $ 502.6 million for violating four patents relating to Internet communications used for FaceTime and iMessage.
This amount was finally canceled in 2019 by a panel of three judges. But the latter had considered that the procedure could continue to judge the fact that certain old models of iPhone infringed the two other patents of VirnetX in question. It is therefore this decision that Apple will seek to overturn on appeal.
VirnetX has often been accused of being a “patent troll” company, that is, buying up patents and then claiming their infringement by large companies in court. The boss of the company has already defended himself in a note published in 2016 on his blog.
